Death driver avoids prison term

An elderly Mount Gambier man who was the driver in a vehicle collision that killed his daughter late last year at Glenburnie was given a two-year good behaviour bond at the Mount Gambier Magistrates Court on Monday.

Lionel Alhard Von Der Borch, 80, was driving his Holden sedan south along Casterton Road on November 27 last year when he drove out in front of another vehicle on the Princes Highway.

The court heard the defendant, who was an ex-police officer, and his daughter were returning home from Hamilton when he failed to give way while crossing the Princes Hwy.

According to defence counsel, Steve MacFarlane, his client did not see the oncoming traffic.

As a result, another Holden sedan smashed into the passenger side of his vehicle, causing it to spin out of control and through a fence.

His then 55-year-old daughter was critically injured and later died in Flinders Medical Centre on December 6.

Von Der Borch and the female driver of the other vehicle escaped with minor injuries.

Von Der Borch was convicted for aggravated driving without due care and his licence was disqualified for 18 months until he can demonstrate to the registrar sufficient physical and cognitive ability to drive a motor vehicle.
